His primary line of defense is that he presented the video exactly as he received it. As in, somebody *else* hatcheted the video before giving it to him, and he *didn't* see the full content of the original video.
It's kind of like Trifectaboy being presented with cherry-picked information about Iraq -- his handlers knew they weren't telling him the entire story, but as long as *he* didn't know that, then he had Plausible Deniability. I guess for (s)elected officials, ignorance is an asset, where for the rest of us, it is No Excuse.
Sadly, I don't think Sherrod will prevail. Sure, Breitbart helped promote the smear, but he's not the one that called her up and said "you're quitting"... he and Faux will be given a pass based on the "lying is Free Speech" precedent, and his "credibility" will only be enhanced in the eyes of Faux and his admirers.
If Sherrod *does* win, it'll be largely because her position in the USDA was neither one of an elected official nor that of a high-profile spokesperson, and therefore she was not a "public figure" in the same way that the President, Congress, the Supreme Court, or the Cabinet are.
As a parting thought: I'm surprised that I haven't heard anybody try to draw parallels to Dan Rather's "forged document" incident...
